
Lindsay Lohan has turned down the plea deal that included jail time. She decided instead to take it to trial. The actress is betting that a jury will believe her side of the story. She has insisted all along, that she is no thief.
“Ms. Lohan has maintained her innocence from the moment this case was filed and she has never wavered,” said her attorney Shawn Holley. “Though many advised her to take the safe route by taking the deal, the truth is she is innocent; she has a strong defense; and we are confident that a jury will acquit her.”
Lohan is accused of stealing a $2,500 necklace from Venice, Cal. jeweler Kamofie. All along the actress has maintained that it was on loan to her. Store owners dispute that version of events.
A preliminary hearing is scheduled for April 22nd to hear testimony. A judge will then decide if there is enough evidence to move forward with a trial.
If convicted, Lohan faces three years in prison. She may also be sentenced to jail time if the judge rules she violated her probation for the DUI case.
Lohan is also in the process of suing the jeweler for selling the surveillance tape of her allegedly stealing the necklace. She claims that they used her image to gain financially without her permission.
The selling of the tape will make the prosecutors’ job a bit challenging as it undermines their key witness’s credibility.
